We suggest the following clauses (of course each transaction is unique and if you have specific questions please contact us directly).

The Buyer shall pay the balance of the purchase price, subject to the usual adjustments by wire transfer.

The parties acknowledge and agree that all closing documentation can be signed electronically and forwarded by email or fax in accordance with the Electronic Commerce Act, 2000, S.O.2000,c.17

The parties agree that the keys to the property shall be left in a lock box at the property and the code to the same is to be provided to the Buyer’s lawyer in escrow pending closing of this transaction.

The parties herein acknowledge and agree that they are required to close this transaction notwithstanding any impacts of COVID-19, save and except the closing of the Land Registry Office(s) and all financial institutions. In the event the closing cannot occur due to a shutdown/disruption of the Land Registry System and/or banking system, then the closing date shall be automatically extended to the fifth (5th) business day following the date upon which said systems have returned to operational status and can clear funds accordingly.

 

> Policy for Preparing the Home Prior to Property Showings

We strongly suggest that prior to a Property Showing, you prepare the home so that minimal contact is necessary. For example:
1. Disinfect the lockbox, all doorknobs, surfaces, light switches and counters with antibacterial / germ killing cleaners.
2. Turn on all lights, open all closet doors, all bathroom / bedroom and other doors so as to minimize the necessity for any agents / buyers to touch any surfaces.
3. Provide hand-sanitizes or germ killing wipes at the door.
4. Shoes Stay Outside or wear booties.
5. Post a note in conspicuous locations that states the agent / buyers are to clean their hands prior to entering the home / during the visit and that the agent / buyers are not permitted to touch surfaces, doorknobs etc.

Sellers must also be aware of the precautions of keeping the home sanitized.  Keep a written record that you have received showing protocols with your sellers.

1. Disinfect the lockbox, all doorknobs, surfaces, light switches and counters with antibacterial / germ killing cleaners.
2. Close all lights and doors
3. Agents: Create a log containing the names of those who have visited the property and their responses to the inquires in the Showing Protocols.  Agents must either keep the Health Questionaire provided below or keep follow-up notes of conversations they've had with their buyers and showing agents. 
If someone ends up being infected the medical officers will need this information to track anyone else that might have been in contact with these individuals.

City of Toronto Implementing Stricter Covid Restrictions

 

Toronto's Medical Officer of Health is introducing new public health measures to help reduce the spread of COVID-19. These will come into effect when the city is moved by the province into the Red-Control Level on November 14. TRREB's interpretation of these rules is that they will continue to allow for real estate showings by appointment following public health directives. TRREB is seeking clarification from the City of Toronto to confirm this interpretation. In-person open houses continue to be prohibited in Toronto during this second wave.

The new protections would come into effect at 12:01 a.m. this Saturday November 14, 2020, and include strengthened COVID-19 precautions for businesses and public spaces:

  • Social gatherings should only be with those you live with and/or one or two essential supports
  • Restrict close contacts only to those you live with and your essential supports
  • Limit in-person activities outside the home to essential activities only – going to work or school, health care, shopping for your household and health needs, and getting exercise and physical activity
  • Businesses and workplaces should implement work from home wherever possible
  • Businesses should review their HVAC systems to ensure they are in good working order
  • Workplaces should appoint a compliance officer to ensure implementation of occupational health and safety and infection prevention and control measures
  • Indoor dining will remain closed
  • Indoor fitness classes are not permitted
  • Meeting and event spaces will remain closed
  • In malls, patrons should not be permitted to consume food or drink while walking through malls
  • Casinos, bingo halls and other gaming establishments will remain closed

 

Open Houses


Open houses continue to be prohibited under provincial rules in Toronto and Peel. For other areas where Open Houses are permitted, TRREB continues to strongly advise members to NOT hold in-person open houses and to continue to take advantage of virtual tools.  Click here for details on TRREB's direction regarding open houses.

 

Provincial Rules Regarding Real Estate


Ontario Regulation 263/20 under the Reopening Ontario Act specifically prohibits open houses in some areas, but is loosening these rules in other areas, as per the regionally based provincial colour-coded COVID-19 Response Framework; however, provincial rules allow for real estate showings, by appointment, to continue across the province.  TRREB continues to advise against holding in-person open houses, even in areas where they may be permitted under provincial rules. Should you require a how-to on live streaming open houses, visit the Stratus headline here.

New COVID Red Zones - Dundas and Bloor Offices Fall Under these Guidelines

 

COVID-19 Restrictions and New Rules

 

As the number of cases have been rising, stricter rules have been imposed in the GTA. 
Workplaces must prohibit all non-essential visitors and make work-from-home options available, as much as possible. 

We are extremely busy and we understand the show must go on!  We can do so safely together.   So if you need to come into the office, please note:

1) Call ahead and book an appointment 
2) Your space will be sanitized when you arrive, kindly sanitize when you leave.
3) No food in the office.  Please take your recyclables when you leave.
4) Remember, we have Bank Deposit and Wire Transfer options for Deposits if clients are not comfortable coming in. 
5)  Doors will remain locked, just ring the buzzer.  With our offices being located on busy streets we tend to have random people coming in for strange reasons, especially at Bloor, asking to use our private washrooms.

New restrictions from Peel Public Health take effect on Monday after city placed in Red-Control zone

  • Social gatherings celebrating holidays and life events in business establishments are not allowed.
  • Workplaces must prohibit all non-essential visitors and make work-from-home options available, as much as possible.  
  • Meeting and event spaces, including banquet halls, must close.  
  • Peel residents must restrict their contact to members of their household and essential supports only. Those that live alone may join one designated household. 
  • Peel residents should not visit any other household or allow visitors to their homes or yards, except for emergency reasons, including medical and repairs, renovations or construction, deliveries and one-on-one tutoring. Proper precautions must always be used in these situations, including mask wearing, distancing, hand hygiene, and isolating if sick.  

These measures were issued under Ontario Regulation 263/30, Rules for Areas in Stage 2, sec. 2 (2).
